These Terms are an agreement between you and Platypen LLC ("Platypen," "we," "us"). The app, this website and those related services are collectively the "Services." The Privacy Policy explains how we handle information.
These Terms become effective when you first access or use the Services. Material updates affecting app use become effective when you affirmatively accept them. Website updates apply as described in Section 17.
Key Terms
- You own the content you create. We receive only the rights needed to provide, secure, and support the Services.
- We do not use app content to train AI models or generally improve our products. We may use limited usage and diagnostic information, including pseudonymous product events, and reports you deliberately send us.
- Primary app content is stored on your device and in Apple's private and shared iCloud services when your Apple account and system settings allow. Requested online features send the information they need to Platypen and our providers.
- Purchases and subscriptions are handled through the app store, including its payment, renewal, cancellation, and refund rules.
- AI output can be wrong or unexpected. Review it before relying on it.
- The Apple Standard EULA governs the license to an Apple-distributed app. These Terms govern Platypen's Services.
1. Accepting These Terms
By accessing or using the Services, you agree to these Terms. In the app, you also accept these Terms by proceeding through an onboarding screen that links to them and states that continuing means you accept them.
If you do not agree, do not access or use the Services. If you use a Service for an organization or another person, you represent that you have authority to accept these Terms for them.
The Privacy Policy explains how we handle information. Accepting these Terms is not consent to a data practice that requires separate consent.
2. Who May Use The Services
You must be at least 18 years old and legally able to enter into this agreement. The Services are intended for adults. Children may not accept these Terms or independently operate or use the Services.
You may not use the Services if applicable law prohibits you from doing so.
3. App Stores, Purchases, And Subscriptions
Some features require a purchase, subscription, entitlement, or usage allowance. Purchases through Apple or another app store are also governed by that store's terms, payment and refund rules, subscription controls, and regional consumer protections.
Subscriptions automatically renew unless canceled through the applicable app store before renewal. Deleting an app or app data does not cancel a subscription. Any free trial converts to a paid subscription unless canceled under the app store's rules before the trial ends.
We may verify entitlements, enforce documented usage limits, restore purchases, and correct purchase status.
We may apply rate limits and other safeguards to protect the Services and prevent fraud or abuse. We do not disclose every security threshold.
We may change future prices or plans with notice required by the app store or applicable law. A price change does not alter a billing period already purchased.
We may offer a subscription or plan that covers more than one app. The purchase screen identifies the apps and features included in that plan. A multi-app plan does not include every current or future Platypen app. We may use a shared account or entitlement identifier to recognize plan access, restore purchases, and prevent duplicate subscriptions. Any separate terms for a multi-app plan apply only if you choose that plan.
4. Apple Standard EULA And These Terms
For an app downloaded from Apple's App Store, Apple's Licensed Application End User License Agreement ("Apple Standard EULA") governs the license to install and use the app unless Platypen provides a custom EULA for that app in your country or region.
The Apple Standard EULA and these Terms are separate, complementary agreements. The Apple Standard EULA applies to the app license and the other matters it expressly covers. These Terms add terms governing Platypen's Services, subscriptions, content, AI and connected-service features, support, acceptable use, suspension, and disputes between you and Platypen. If they conflict, the applicable Apple EULA controls the matters it governs. These Terms supplement the Apple EULA to the extent they are consistent with it. Mandatory rights under applicable law control over both.
These Terms are between you and Platypen, not Apple. Apple has no obligation to provide Platypen support. Purchases, refunds, subscriptions, iCloud, and other Apple platform services are also subject to Apple's terms. You must comply with applicable third-party terms when using the Services. Nothing in these Terms makes Apple a party to these Terms, imposes an obligation on Apple, requires Apple to provide the Services, or changes Apple's rights under an applicable EULA.
5. Your Content
You may create, store, submit, or process text, prompts, images, records, notes, conversations, and other material through the Services ("Your Content").
You retain your rights in Your Content. You give Platypen a limited, non-exclusive, worldwide license to host, copy, transmit, format, display, and otherwise process Your Content only as reasonably needed to:
- provide a feature you request;
- maintain, secure, troubleshoot, and support the Services;
- prevent fraud, abuse, or harm;
- comply with law; and
- enforce these Terms.
This license ends when the processing is no longer needed for those purposes, subject to ordinary deletion cycles and limited security, fraud, transaction, dispute, backup, and legal records described in the Privacy Policy.
We do not sell Your Content. We do not use Your Content to train AI models or use app content to generally improve our products. We do not permit an AI provider used for a production app feature to train or improve its general-purpose models using Your Content. We use commercial or paid provider services that support this restriction and do not opt in to voluntary provider training or data-sharing programs.
If you deliberately submit a support message, feedback, suggestion, bug report, or diagnostic attachment (a "Report"), you give us permission to use that Report to respond, troubleshoot, secure, maintain, and improve the Services. We may also use limited usage and diagnostic information, including pseudonymous product events, to operate, secure, and improve the Services.
You are responsible for Your Content and must have the rights and permissions needed to submit and use it. Do not submit credentials, government identifiers, or other sensitive information a feature does not ask for. You may not use the Services to create, upload, or share illegal, exploitative, abusive, infringing, deceptive, or harmful material.
6. Device Storage, iCloud, And Sharing
Primary app content is stored on your device and in Apple's private and shared iCloud services when your Apple account and system settings allow. Platypen does not ordinarily store a complete central copy of your app content. Requested online features may still process information through Platypen and provider systems as described in the Privacy Policy.
You are responsible for maintaining your device, Apple account, backups, and access controls. Turning off sync or deleting an app may not delete information already stored in iCloud, disconnect a linked service, cancel a subscription, or remove limited provider records. Follow the app-specific deletion guide linked from the Privacy Policy.
You choose whether to share a profile and who receives access. A recipient may retain a copy after access is revoked. The Privacy Policy and data guide explain sharing and deletion limits.
7. AI Features
Some features use artificial intelligence to generate, revise, summarize, illustrate, narrate, or respond to content. AI output can be inaccurate, incomplete, repetitive, unexpected, unsuitable, or similar to material generated for someone else.
You are responsible for reviewing output before relying on, saving, sharing, publishing, or acting on it. We do not guarantee that output will be accurate, unique, appropriate, available, or free from third-party rights claims.
Do not rely on AI output alone for an emergency or for medical, legal, safety-critical, or other high-stakes decisions.
8. Third-Party Services
The Services use third-party platforms and providers, including app stores, operating systems, iCloud, hosting and security providers, AI providers, analytics providers, connected services, and payment systems.
Third-party services have their own terms and privacy notices. They may process information needed for a requested feature and may retain content or metadata for service operation, caching, diagnostics, security, fraud and abuse prevention, support, legal compliance, service development, and other purposes allowed by their terms. Some providers act only on Platypen's instructions; others, such as Apple and services you choose to connect, may independently determine how they process information. The Privacy Policy explains the main categories.
We select and configure AI providers so that Your Content is not used to train or improve their general-purpose models. This training restriction does not prevent limited retention or human review for security, abuse prevention, service operation, diagnostics, support, or legal compliance as described in the Privacy Policy. We are not responsible for an independent third-party service, website, or platform outside our control.
9. Acceptable Use
You agree not to:
- violate law or another person's rights;
- access or attempt to access systems, data, or accounts without permission;
- interfere with the operation, integrity, or security of the Services;
- submit malware, credentials, secrets, or harmful code;
- scrape, copy, reverse engineer, or bypass access controls except where applicable law expressly permits it;
- use automated means to extract data from the Services to build a competing dataset or train a model;
- use the Services to create or distribute illegal, exploitative, abusive, harassing, deceptive, infringing, or harmful material;
- misrepresent AI-generated material as human-created where disclosure is required by law;
- misuse app-store, purchase, entitlement, provider, or usage-limit systems; or
- use the Services in a way that could harm Platypen, our providers, or other users.
10. Intellectual Property And Open Source
Platypen and its licensors own the Services, including software, design, text, graphics, trademarks, and other materials, except for Your Content and third-party materials. These Terms do not transfer ownership of the Services to you.
Some Services include open-source software governed by separate licenses. Required notices appear in the app.
11. Support, Changes, And Availability
Contact support@platypen.com for support. We try to respond to reasonable requests but do not promise a particular response time unless applicable law requires one.
We may update, change, suspend, limit, or discontinue a Service or feature, including a beta or experimental feature. We will provide notice and refunds when required by applicable law or app-store rules. We do not guarantee that every feature, provider, or item of content will be available in every country, language, device, or release.
12. Suspension And Termination
You may stop using the Services at any time. We may suspend or terminate access if you materially violate these Terms, create legal or security risk, misuse the Services, or if suspension is reasonably needed to protect users, providers, the Services, or Platypen.
Where reasonable, we will give notice and an opportunity to correct the issue. Sections that by their nature should survive will survive, including ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute terms.
13. Disclaimers
Diaper Days helps you record and organize care. Its charts, growth references and reminders do not provide medical advice, diagnosis or treatment. Check imported or AI-generated events before saving them, and do not rely on reminders as your only way to manage medication or other essential care.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, PLATYPEN DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
Some jurisdictions do not allow certain disclaimers or provide nonwaivable consumer guarantees. This section does not limit those rights.
14. Limitation Of Liability
TO THE FULLEST EXTENT ALLOWED BY LAW, PLATYPEN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OPPORTUNITIES, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.
TO THE FULLEST EXTENT ALLOWED BY LAW, PLATYPEN'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO A SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THAT SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$50.
These limits do not apply to liability that cannot lawfully be limited, including where applicable liability for fraud, willful misconduct, death or personal injury caused by negligence, or violation of nonwaivable consumer rights.
This Section states Platypen's liability limit under these Terms. It does not increase a separate limit that applies under the Apple Standard EULA. Recovery under the Apple Standard EULA and these Terms is not cumulative for the same injury.
15. Indemnity
To the fullest extent allowed by law, you will indemnify and hold Platypen harmless from third-party claims, liabilities, damages, losses, and reasonable expenses arising from Your Content, your unlawful or unauthorized use of the Services, your material violation of these Terms, or your violation of another person's rights.
This section does not apply to the extent prohibited by consumer law and does not require you to indemnify Platypen for Platypen's own negligence, willful misconduct, or violation of law.
16. Governing Law And Courts
California law governs these Terms, without regard to conflict-of-law rules.
For a United States dispute, you and Platypen consent to the state and federal courts with jurisdiction over Sacramento County, California, except that an eligible claim may be brought in small claims court and applicable law may provide another mandatory forum.
If you reside outside the United States, nonwaivable consumer protections and mandatory courts or forums available under the law of your place of residence continue to apply. Nothing in these Terms deprives you of a protection or forum that cannot lawfully be waived.
17. Changes To These Terms
We may update these Terms. For an app user, we will provide reasonable notice of a material change and request affirmative acceptance before a material update takes effect. Adding or changing terms for another app or plan does not change these Terms.
For a public website, updated Terms apply on the stated effective date. By using the website on or after that date, you accept the update to the extent permitted by law.
The "Last updated" date identifies the current version. Continuing to use a Service after a nonmaterial update takes effect constitutes acceptance where permitted by law.
18. General Provisions
These Terms and documents expressly incorporated by reference are the entire agreement between you and Platypen about the Services, except for the separate Apple Standard EULA and provider-specific terms that apply to third-party services. Any separate plan terms you accept apply to that plan.
If any provision of these Terms is unenforceable, the remaining provisions stay in effect. The unenforceable provision will be enforced to the greatest extent allowed by law. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a sale or restructuring of Platypen, subject to applicable law. Headings are for convenience only.
